AGB's - General terms and conditions of the blessed GmbH (translated from german) 

§ 1. General

The following general terms and conditions (GTC) apply to all, including future, contracts, deliveries and other services of Blessed GmbH, Burgerstrasse 5, 3063 Ittigen (hereinafter: Blessed) to its customers. The version of the General Terms and Conditions valid at the time of the order always applies. Any provisions of the customer are hereby rejected.

Blessed only recognizes deviating conditions if this has been expressly agreed in writing. All additional agreements require written confirmation. The business relationships between Blessed and the customer are subject to Swiss law to the exclusion. Place of jurisdiction is Berne.

The purpose of the company is the import, trade and sale of goods of all kinds, in particular clothes, shoes and sporting goods, as well as the provision of all services in the areas of hospitality, gastronomy, entertainment, events, travel and life advice. The company can acquire, hold and exploit intellectual property rights and real estate. The company can set up branches at home and abroad, participate in other companies at home and abroad, acquire similar or related companies or merge with such, acquire, manage and sell real estate and enter into all transactions and conclude contracts that are suitable are to promote the purpose of the company, or which are directly or indirectly related to it.

§ 2 Content of contract and conclusion of contract

§ 2.1. offer
Blessed offers its customers the opportunity to order and buy all kinds of products via the website www.blessed.ch. If the online shop fails, customers can also email their order list to: onlineshop@blessed.clothing . A verbal or telephone order is only possible in exceptional cases (e.g. if there is no Internet access). All Blessed offers are non-binding and while stocks last. Deviations from the image material and technical changes compared to the illustrations or descriptions are possible and we expressly reserve the right to do so.

§ 2.2. Prices
All prices are in CHF, Euro (€), USD ($) or British Pounds (£). Blessed GmbH has been exempt from statutory VAT since January 1st, 2020. For customers outside of Switzerland, VAT is not included in the price and varies from country to country and is charged by the local customs office. The price includes all other price components, except for the additionally specified shipping costs and the terms of payment. Subject to errors. In the case of an incorrect price, Blessed reserves the right to withdraw from the contract.

§ 2.3. formation of the contract
The contract comes about through the acceptance of the order and the confirmation of the order by Blessed. Blessed notifies the customer of acceptance of the order by email. After receiving the order, Blessed will check the availability of the ordered goods. If parts of the order are not available, Blessed will inform the customer as soon as possible, who then has the right to withdraw from the contract or to choose other items.

§ 2.4. payment arrangements
Unless explicitly agreed otherwise, the invoice amount is to be transferred in CHF within 10 days to the account specified by Blessed, stating the order number. Payments from abroad are only accepted in CHF. Any fees incurred for the exchange of a foreign currency into CHF are to be borne by the customer. We basically offer the payment methods credit card, PostFinance, PayPal and invoice. With every order, we reserve the right not to offer certain payment methods and to refer to other payment methods.

§ 2.4.1. Payment in advance
If the total amount for an order in advance is not received on the specified account within 30 days and the customer has not canceled the sales contract in writing or by e-mail free of charge within this period, Blessed reserves the right to invoice the order to the to send customers or to withdraw from the purchase contract. Therefore, no guarantee can be given for the availability of the goods after the payment period has expired.

§ 2.4.2. PayPal
If the total amount for an order via PayPal has not been credited to the specified account within 30 days and the customer has not canceled the sales contract in writing or by e-mail free of charge within this period, Blessed reserves the right to invoice the order to the to send customers or to withdraw from the purchase contract. Therefore, no guarantee can be given for the availability of the goods after the payment period has expired.

§ 2.4.3. Credit card (Visa, Mastercard) and Postcard
In the case of a purchase on a credit card, your credit card account will be debited upon completion of the order. Please note that we only accept payments from accounts within the European Union (EU) and Switzerland. In no case do we assume the costs of a money transaction. If the total amount for an order has not been credited to the specified account within 30 days and the customer has not canceled the sales contract in writing or by e-mail free of charge within this period, Blessed reserves the right to invoice the customer for the order ship or withdraw from the purchase contract. Therefore, no guarantee can be given for the availability of the goods after the payment period has expired.

§ 2.5. late payment
If the total amount for an order has not been credited to the specified account within the deadline and the customer has not canceled the sales contract within this deadline by returning the products,
reminder costs of CHF 5 per reminder and default interest of 5% will be incurred. Furthermore, Blessed reserves the right to commission a debt collection company to collect the money from the customer. A return of the products after this period is not possible, the customer has to pay the entire amount. Returned items can be sent back to the buyer for a fee. The collection agency commissioned is entitled to charge additional default interest to the customer. In no case do we assume the costs of a money transaction. For customers with unpaid invoices, we reserve the right to use advance payments for new orders and orders to settle overdue invoices. Blessed GmbH also reserves the right to hold back deliveries of goods in the event of default of payment and to only start new orders when all debts have been settled and the advance payment has been made in full.

§ 2.6. Pricing information
Prices in advertisements are subject to change and non-binding and are only valid while stocks last. Blessed reserves the right to set different prices depending on the group of buyers. Customers cannot subsequently dispute the prices if they change after the conclusion of the contract or are lower for other groups of buyers.

§ 2.7. Exclusion of Customers
Blessed reserves the right to refuse delivery to a customer, stating reasons.

§ 3 Delivery, self-delivery reservation and transfer of risk
Unless otherwise contractually agreed, the ordered goods will be delivered to the address specified by the customer. Blessed reserves the right to make a partial delivery if this appears advantageous for speedy processing. Special forms of shipment requested by the customer will be charged separately and additionally.

Information about the delivery period is non-binding, unless Blessed has promised the delivery date in a binding manner. Goods that are in stock are sent by Blessed within 14 working days. If the goods are not in stock when the order is placed, Blessed will endeavor to deliver as quickly as possible. If non-compliance with a delivery or service deadline is due to force majeure, labor disputes, unforeseeable obstacles or other circumstances for which Blessed is not responsible, the deadline will be extended appropriately.

Blessed reserves the right to release itself from the obligation to fulfill the contract if the goods are to be delivered by a supplier on the day of delivery and the delivery is omitted in whole or in part. This self-delivery reservation only applies if Blessed is not responsible for the non-delivery. Blessed is not responsible for the non-performance if a so-called congruent hedging transaction to fulfill the contractual obligations was concluded in good time with the supplier. If the goods are not delivered, Blessed will immediately inform the customer of this fact and refund the purchase price in the form of a voucher.

If a shipment is lost, Blessed will inform the customer of the shipping number (if there is one) so that the shipping company can get a replacement or a replacement as soon as possible. However, Blessed clearly distances itself from any shipping risk and assumes no liability for shipping. For orders, which the customer chooses as a shipping method by letter, large letter or Packet Economy Europe/Worldwide, the customer bears full responsibility, as there is no shipping number and therefore no insurance.

§ 3.1.1 Delivery and shipping costs
Blessed GmbH charges a shipping fee per delivery depending on the weight, size and destination of the shipment. An additional fee of CHF 15.00 applies for shipping by invoice.

§ 3.1.2 Shipping abroad
Please note that for deliveries abroad (outside of Switzerland), any fees for customs clearance (customs & import sales tax) will be charged to the customer. Since customs regulations vary from country to country, we cannot predict the amount of customs duties. Please inquire about this at your responsible customs office. The resulting fees are charged by the shipping company and collected directly from them.

§ 3.1.3 Faulty delivery by Blessed
If the customer receives the wrong products, sizes or an incorrect delivery, the shipment must be returned to Blessed within 10 days with a note of the problem. Blessed GmbH will try to find a replacement as soon as possible and will reimburse the customer for the postage costs of a B Mail or Parcel Economy delivery by Swiss Post. If the customer returns the packages with another shipping company or another shipping method, he has to bear the full costs for this himself.

§ 3.2. exchange
The exchange of ordered goods is possible if the desired exchange size or the desired product is in stock. This can be queried by email at onlineshop(at)blessed.ch. Reduced items cannot be exchanged. For all goods to be exchanged, the delivery address, the order number and the desired product and, if available, the size/color must be specified. Excluded from exchange are: for hygienic reasons, the following products: socks, underwear and swimwear as well as reduced items. The newly incurred shipping costs for the exchange are to be paid in full by the customer and included in the return in cash. These additional shipping costs are to be paid in the same amount as already stated in the invoice. If these costs are not settled, blessed reserves the right to issue the customer with an invoice for this amount.

§ 3.3. providing incorrect data
A shipment that is refused or not picked up by the parcel shop and is therefore sent back to us represents a valid revocation. However, we will charge you for the costs incurred, such as postage, as this is an additional service you have requested and these are costs incurred by Blessed GmbH.

If an incorrect address was deliberately given for a shipment, this represents an attempt at fraud. We will then hand over the collected data and the IP address of the customer to the responsible authorities. Blessed will invoice the customer for the damage incurred and, if necessary, assert a claim in court.

§ 4 Retention of title, offsetting
The delivered goods remain the property of Blessed until all claims to which Blessed is entitled in connection with the contract have been settled. The customer only has the right to offset if his counterclaims have been recognized by Blessed or have been legally established. The customer is only authorized to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.

§ 5 cancellation policy

§ 5.1 Right of withdrawal:
Consumers have a 30-day right of withdrawal. A recall of the products after this period is no longer possible, in this case the customer must pay the entire amount. In the case of all cancellations, the order number must be given. The following products are excluded from the right of withdrawal for hygienic reasons: socks, underwear, swimwear and drinks, as well as all reduced goods. Consumers can revoke their contractual declaration within 30 days in writing (letter or e-mail) and by returning the goods, stating reasons. The resulting postage costs will be charged to the customer and must be paid to Blessed. The period begins when the goods are sent (postmark or according to tracking). The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline. The revocation must be sent to:

§ 5.2 Consequences of revocation:
In the event of an effective revocation, the mutually received services are to be returned. If you cannot return the service received to us in whole or in part, or only in a deteriorated condition, you may have to pay us compensation for the value. This does not apply to the surrender of items if the deterioration of the item is solely due to their inspection - as you would have been able to do in a retail shop. You can also avoid the obligation to pay compensation by not using the item as if it were your property and refraining from anything that could impair its value. Transportable items are to be sent back. You have to bear the costs of the return if the delivered goods correspond to those ordered or if you have not yet paid the consideration or a contractually agreed partial payment at the time of the cancellation if the price of the goods is higher. We will not refund any shipping charges you request. In the event of a cancellation, the customer bears the risk of returning the purchased item. Obligations to refund payments must be fulfilled within 3 days after sending your notice of cancellation. The period begins for you with the dispatch of the goods, for us with the receipt. After receipt of the return, the customer will be reimbursed the value of the goods in the form of a credit note (voucher). The customer has to bear the costs of the return.

§ 6 Reseller

§ 6.1 Shopping options

§ 6.1.1. Own purchase:
You decide for yourself which products you want, in which colour, quantity and size.

§ 6.1.2. Purchasing support from Blessed

§ 6.2 Purchase prices for resellers:
Resellers receive a 50% discount on the retail price of the goods (of the customers). The purchase prices of the resellers do not include shipping costs and VAT. The margin is therefore 50% less shipping costs and VAT. The discounts of the resellers are automatically deducted in the shopping cart and the VAT and shipping costs are added.

§ 6.2 Selling prices of the resellers:
The retail prices are set by Blessed and must be adhered to by resellers.

§ 6.2 Sale, campaign week, discounts, etc. of the resellers
The prices set by Blessed may only be freely reduced by you as a reseller once every six months for a maximum of one month (sale, campaign week, etc.). The period can be freely chosen by the reseller, there is no obligation to report.

§ 7 Online Partners

§ 7.1 General:
The entire paragraph 7 of the terms and conditions only applies to the online partners and is part of the terms and conditions of Blessed GmbH. All Blessed GmbH terms and conditions apply to online partners and not just paragraph 7. Paragraph 7 applies to online partners and overrules other terms and conditions of the terms and conditions if there are similar or overlapping points.

§ 7.2 Selling Prices
The sales prices are set by Blessed and must be adhered to.

This for various reasons:

1. The different stores must have the same retail prices in order not to undercut each other or charge excessive prices.

2. Our products should not be associated with "cheap goods". We attach great importance to good quality and fair production and do not want these values ​​to be lost through low prices.

3. In order not to damage the good reputation and value of the Blessed brand.

§ 7.3 Sale, campaign week, discounts, etc.
The prices set by Blessed GmbH may only be freely reduced once every six months for a maximum of one month by the online partner (sale, campaign week, etc.). The period can be freely selected by the online partner, there is no obligation to register. However, prices will be charged by Blessed at the same rate as usual. The discounts given are therefore entirely at the expense of the Blessed Online Partner. There is no entitlement to a reduction at Blessed.

§ 7.4 Prices:
The current product prices can be seen at any time in the Blessed online shop and will be sent to you every six months with the current stock list. We will also be happy to give you information about sold-out products or product prices at the following e-mail address: question@blessed.ch . If Blessed GmbH grants discounts on its own website, these only apply to end customers.

§ 7.5 Terms of delivery:
Prices include shipping to the customer by B Post (Economy). Any A Mail, Priority or Express shipping costs are fully (without deduction) at the expense of the Blessed Online Partner. The latter can demand such costs from its customers at its own discretion. Shipping is usually carried out by Swiss Post or, in exceptional cases, by a courier or, if possible, by Blessed GmbH.

§ 7.6 Forward orders to Blessed:
All orders received by the Blessed online partner must be forwarded to Blessed GmbH by email to onlineshop@blessed.clothing in writing as a PDF. All orders must be presented in the same layout.

§ 7.7

Guarantee, warranty for defects and liability:
For all products that can be purchased from Blessed GmbH, the guarantee period is 1 month from the day the goods leave our premises. In warranty cases, the products must be submitted directly to Blessed GmbH. The costs for returns are at the expense of the customer. The guarantee covers all defects that occur within the agreed guarantee period, provided that they can be proven to be caused by poor material or faulty manufacture. However, liability is limited to repair, replacement or reimbursement of the value of the defective goods in the form of a voucher at the option of the guarantor. Further claims of the buyer are excluded. In particular, Blessed GmbH is not liable for damage that can be traced back to improper use or natural wear and tear or for damage that has not occurred to the delivery item itself (consequential damage). Claims for replacement/reimbursement of lost sales profits or the like are excluded. Changes or repair work carried out without our or the manufacturer's written consent, as well as non-compliance with the General Terms and Conditions, void the warranty obligation.

§ 7.8 Vouchers:
Each shop has its own vouchers, which are only valid in its own shop. Blessed vouchers are only valid in Blessed GmbH shops and in the Blessed online shop.

§ 7.9 Sponsorship:
Blessed sponsored athletes can only purchase their merchandise directly from the Blessed office. The contractual partner can sponsor people and grant discounts in their own shop at their own discretion.

§ 7.10 Blessed Logo:

The contractual partner may use the Blessed logo for his own purposes if permission (good for printing / good for publication) has been obtained from Blessed GmbH. Blessed GmbH can prohibit the contractual partner from using the Blessed logo, stating reasons. The logos are available on request by mail. If the cooperation is terminated, the name Blessed, the logo or parts of the corporate design, as well as images of Blessed GmbH may no longer be used unless Blessed GmbH allows this in writing.

§ 7.11 Third-party brands:
The contractual partner may, at its own discretion, include third-party products and brands in its range. Stores that bear the Blessed name must not fall below the minimum quantity of 50% of Blessed products.

§ 7.12 Duration of contract:

This contract is valid from the first purchase and remains in effect until the cooperation is terminated. Changes are sent by Blessed GmbH in writing or by e-mail to the contractual partner.

§ 8 To be observed in the case of transport damage
Externally recognizable damage to the shipments must be certified by the deliverer of the shipment immediately and in a suitable manner. The transportcompanies are obliged to do so. If you notice any damage, defects or weight reductions in the contents that are not visible from the outside, you should stop unpacking immediately. The transport company must be held liable in writing immediately and requested to determine the damage.

In all cases, the goods and packaging must be left in the condition they were in when the damage was discovered until the facts have been recorded by the representative of the transport company.

§ 10 Vouchers:
Blessed vouchers are only valid in Blessed GmbH shops and in our own online shop. Resellers have their own vouchers, these are not valid in the Blessed online shop or in Blessed GmbH shops.

Section 11 Liability
The customer can only assert claims for damages outside of the statutory warranty claims against Blessed in the event of intent or gross negligence. This exclusion of liability does not apply in the event of injury to life, limb or health and in the event of a breach of essential contractual obligations.

Except in the case of intent, gross negligence and damage resulting from injury to life, limb or health, the liability of Blessed is limited to the damage that was typically foreseeable at the time the contract was concluded. Liability under the Product Liability Act and other mandatory statutory provisions remains unaffected.

§ 12 Copyrights
The photographs, graphics and texts used on the www.blessed.ch and www.blessed.clothing websites are protected by copyright.

Any use of the photographs, graphics and texts and the designation bd, the designation blessed, as well as all brand names, trademarks and registered trademarks are only permitted with the written consent of Blessed. Written permission is always required!

All rights, errors and changes reserved. Information from texts, images and graphics are protected by copyright and other protective laws. § 15 Severability Clause
Should individual provisions of the contract, including these provisions, be or become wholly or partially invalid, or should the contract contain an unforeseen gap, the validity of the remaining provisions or parts of such provisions shall remain unaffected. Instead of the invalid or missing provisions, the respective statutory regulations apply.
